These Terms of Service apply to your use of The Shortlist Training Co. website, application forms, payment links, coaching services, digital materials, and related communications.

By using this website, submitting an application, purchasing coaching, or participating in coaching services provided by The Shortlist Training Co., you agree to these Terms.

1. Business Information

The Shortlist Training Co. provides online fitness coaching, strength and physique programming, accountability, progress tracking, and general nutrition guidance.

2. Coaching Services

The Shortlist Training Co. may provide services including, but not limited to:

• Training programs

• Exercise guidance and technique feedback

• Progress tracking

• Check-ins and accountability

• General nutrition guidance

• Habit, routine, and lifestyle support related to fitness goals

• Online assessments or video consultations

• Access to coaching software, resources, and communication channels

Specific services may vary depending on the coaching package purchased.

3. No Medical Advice

The Shortlist Training Co. does not provide medical advice, diagnosis, treatment, physical therapy, psychotherapy, or registered dietitian services.

All coaching, training, and nutrition information is provided for general fitness and educational purposes only. You are responsible for consulting a qualified healthcare professional before beginning any exercise, nutrition, or lifestyle program, especially if you have a medical condition, injury, pain, pregnancy, medication use, disability, or other health concern.

If medical clearance is required before participation, coaching cannot begin until appropriate clearance has been provided.

4. Client Responsibility

You are responsible for:

• Providing accurate and complete information during application, screening, and onboarding

• Informing The Shortlist Training Co. of any injuries, medical conditions, limitations, medications, or relevant health changes

• Performing exercises safely and within your ability

• Using appropriate equipment and training environments

• Stopping any exercise that causes unusual pain, dizziness, shortness of breath, chest pain, or other concerning symptoms

• Seeking medical attention when appropriate

• Following all safety instructions provided by your gym, facility, healthcare provider, or equipment manufacturer

You understand that physical training carries inherent risks, including soreness, strain, injury, illness, or other adverse outcomes.

5. Eligibility and Acceptance

You must be at least 18 years old to purchase coaching services unless written parent or guardian consent is provided and accepted by The Shortlist Training Co.

Submitting an application does not guarantee acceptance into coaching.

The Shortlist Training Co. may decline, pause, or discontinue coaching if your needs fall outside the scope of service, if required clearance is not provided, or if the coaching relationship is not considered appropriate, safe, or workable.

6. Payments and Billing

Payments are processed through third-party payment providers such as Stripe or other approved platforms.

By purchasing a coaching subscription or package, you authorize payment according to the billing option selected at checkout.

Available billing options may include monthly payments, payments every 2 weeks, weekly payments, fixed-term packages, promotional offers, or private-rate offers.

Prices may vary based on package, promotion, founding-member status, private offer, or payment frequency.

7. Minimum Commitment

Unless otherwise stated in writing, online coaching requires a minimum commitment of 12 weeks, generally fulfilled through 6 payments.

After the minimum commitment is complete, coaching may continue on a recurring basis until cancelled according to these Terms and the applicable payment platform process.

In cases of injury, medical concern, major financial hardship, or other significant life circumstances, coaching terms may be reviewed on a case-by-case basis.

8. Failed Payments

If a payment fails, The Shortlist Training Co. may pause coaching services, programming, check-ins, app access, or other service components until payment is resolved.

You are responsible for keeping your payment method current.

Repeated failed payments may result in suspension or cancellation of services.

9. Cancellations

After the minimum commitment has been completed, you may cancel your recurring coaching subscription by providing written notice at least 14 days before your next billing date.

Cancellation is not confirmed until acknowledged in writing by The Shortlist Training Co. or processed through the payment platform.

Cancelling a payment method, blocking a charge, deleting an app, or ceasing communication does not automatically cancel your subscription or remove payment obligations.

10. Refunds

Refunds are governed by The Shortlist Training Co. Refund Policy.

By purchasing coaching or submitting payment, you agree to the Refund Policy in effect at the time of purchase.

11. Pauses and Holds

Coaching pauses may be offered at the discretion of The Shortlist Training Co.

Pauses are not guaranteed and may not be available for all packages, promotions, founding-member rates, tester rates, or private offers.

If a pause is approved, billing, programming, and coaching access may be adjusted according to the agreed terms.

12. Results Disclaimer

Results are not guaranteed.

Your results depend on many factors, including consistency, effort, nutrition, sleep, stress, genetics, health status, training history, adherence, and lifestyle.

The Shortlist Training Co. may provide guidance, structure, accountability, and support, but you are responsible for your own participation and execution.

13. Nutrition Guidance

Nutrition guidance provided by The Shortlist Training Co. is general in nature and intended to support fitness goals.

The Shortlist Training Co. does not diagnose, treat, or prescribe for medical conditions, eating disorders, allergies, intolerances, or clinical nutrition needs.

You are responsible for making food choices appropriate for your body, health, preferences, and any medical guidance you have received.

14. Communication and Check-Ins

Coaching communication may occur through email, coaching apps, forms, video calls, messaging platforms, or other approved channels.

Response times may vary. Unless otherwise stated in writing, coaching does not include 24/7 support, emergency support, or instant messaging access.

Missed check-ins, incomplete updates, or delayed client responses may affect the quality and timeliness of coaching adjustments.

15. Third-Party Platforms

The Shortlist Training Co. may use third-party platforms for payments, forms, video calls, scheduling, coaching delivery, progress tracking, or communication.

Your use of third-party platforms may be subject to their own terms, policies, account requirements, payment rules, and service limitations.

The Shortlist Training Co. is not responsible for outages, errors, access issues, payment processing delays, data loss, or service interruptions caused by third-party platforms.

16. Intellectual Property

All programs, workouts, documents, videos, templates, graphics, written materials, check-in systems, coaching resources, and other content provided by The Shortlist Training Co. are the property of The Shortlist Training Co. unless otherwise stated.

You may use these materials for your own personal fitness use only.

You may not copy, share, resell, distribute, publish, reproduce, modify, or use these materials for commercial purposes without written permission.

17. Privacy

The collection, use, storage, and disclosure of personal information is governed by The Shortlist Training Co. Privacy Policy.

By using the website, submitting an application, purchasing coaching, or participating in coaching services, you also agree to the Privacy Policy.

18. Acceptable Use

You agree not to:

• Misuse the website, forms, payment systems, or coaching platforms

• Submit false, misleading, or incomplete information

• Share your coaching access with another person

• Copy or distribute coaching materials without permission

• Harass, threaten, abuse, or act disrespectfully toward The Shortlist Training Co. or any associated person

• Use coaching materials for your own clients, business, or commercial services

Violation of this section may result in suspension or termination of services.

19. Termination

The Shortlist Training Co. may suspend or terminate services if:

• You fail to make required payments

• You provide false or incomplete information

• You do not complete required screening, waiver, or onboarding documents

• You act abusively, disrespectfully, or inappropriately

• Your needs fall outside the safe or appropriate scope of service

• Continuing the coaching relationship is not considered appropriate, safe, or workable

Termination does not automatically remove responsibility for payments already due.

20. Limitation of Liability

To the maximum extent permitted by law, The Shortlist Training Co. is not liable for any injury, illness, loss, damage, expense, or claim arising from your participation in coaching services, use of training materials, use of third-party platforms, or reliance on information provided.

You participate in coaching voluntarily and at your own risk.

Nothing in these Terms limits liability where such limitation is not permitted by law.

21. Website Information

Information on this website is provided for general informational purposes only.

The Shortlist Training Co. does not guarantee that website content is complete, accurate, current, uninterrupted, or error-free.

Website content may be changed or removed at any time without notice.

22. Changes to Services, Pricing, or Terms

The Shortlist Training Co. may update services, packages, pricing, billing options, features, availability, or these Terms at any time.

Price changes will not affect an active paid commitment period unless communicated and agreed to where required.

The updated version of these Terms will be posted with a revised “Last updated” date. Your continued use of the website or services after changes are posted means you accept the updated Terms.

23. Governing Law

These Terms are governed by the laws of British Columbia and the applicable laws of Canada.

Any dispute related to these Terms or services provided by The Shortlist Training Co. will be handled in British Columbia unless otherwise required by law.

24. Entire Agreement

These Terms, together with any applicable coaching agreement, waiver, payment terms, Refund Policy, Privacy Policy, or written service agreement, form the agreement between you and The Shortlist Training Co.

If there is a conflict between these Terms and a separately signed coaching agreement, waiver, payment term, Refund Policy, or Privacy Policy, the more specific document will apply to the extent of the conflict.
